Florida Appellate Court Reverses Denial of Summary Judgment Despite Contrary Judgment Following Jury Trial

On July 11, 2012, the Florida Fourth District Court of Appeal issued an opinion in Ioannides v. Romagosa in which it overturned the trial court’s denial of the defendant’s motion for summary

judgment even though the court had entered judgment in favor of the plaintiff following a jury trial.  Exploring the limitation of the United States Supreme Court's opinion in Ortiz v. Jordan, 131 S.Ct. 884 (2011), the Fourth District Court of Appeal found that the denial of the defendant’s motion for summary judgment was appealable because it turned on a purely legal question of whether an integrated written agreement precludes claims for fraud based on pre-writing oral statements concerning subjects addressed by the writing.
