Commercial Agency Law- beware the differences in the UK

Contact: Blake Morgan LLP (Southampton, England)

The effect of the Commercial Agents (Council Directive) Regulations 1993 ("the Regulations") in the UK can be quite different from other jurisdictions which have implemented the EU Directive. One significant difference in the UK is that parties are able to elect between compensation and indemnity. In addition, differences can be found in the duties of agents and principals and the effects of terminating the contract due to a breach by the agent.

As a result of the various differences that may arise, it is important to get specialist advice when advising Principals or Agents who operate in the UK. This article on the Blake Morgan website provides a summary for legal advisors outside the UK of commercial agency law in the UK.
