New Rules on Banking Activities and Financial Institutions

Law no. 23-A/2022, of 9 December was published, which transposes Directive (EU) 2019/878 and Directive (EU) 2019/879 on access to banking and prudential supervision and the recovery and resolution of credit institutions and investment firms, respectively.

This law amends the Legal Framework for Credit Institutions and Financial Companies, as well as the Securities Code and related legislation, namely Law no. 63-A/2008 of 24 November (on measures to strengthen the financial soundness of credit institutions), Law no. 35/2018 of 20 July (establishing the legal framework for the design, marketing and provision of advisory services on structured deposits) and Decree-Law no. 31/2022 of 6 May (establishing the legal framework for covered bonds).
